How long will it take before I hear back about my enquiry?

Providing all information has been provided as per the EOI form, please allow up to 3 weeks to hear back from the Rio Tinto Land Tenure Officer.

What types of considerations determine the outcome of my application?

Each application will be assessed on an individual bases, however some general considerations for assessment will include:

  1. Whether a caveat may exist on parcels of land
  2. Whether the area is subject to current or future development planning
  3. Underground infrastructure such as water, power, sewerage, and stormwater drainage
  4. Proposed area is not suitable due to creating a dogleg or access issues for neighbouring properties
  5. Environmental reasons i.e., contaminated land
  6. Traditional Ownership of land

If my neighbour doesn’t want to buy their adjoining land will that stop me?

NO – if your request doesn’t create a dogleg or prevent access to services and/or neighbouring properties and all the above criteria is met.

What happens if there is already an EOI application for the same area/property I am wanting to enquire about?

All applications will be assessed fairly. If there is already an application in process and a second application is received of the same interest, it is only fair that the first application concludes the EOI enquiry process. Should the initial application not meet all requirements then the second application may be considered.

All enquiries will be kept on file for future opportunities.

Is a new fence required along the new boundary?

Yes – a condition of the sale will include the requirement for the property owner to fully fence the amalgamated lot within 12 months.

Can I build on the new land?

Yes, providing there is no registered easement for infrastructure such as sewerage and water. All building works must comply with the Building Act 1975 and associated regulations and building standards.

Can I install rear access or a second driveway to my property once the new lot has been amalgamated?

Vehicle access outside of designated roadways/corridors is not permitted.

Additional driveways or crossovers require approval from Weipa Town Authority.
